Terms of Service


This policy represents the HostBelle.com Terms of Service ("TOS") in its entirety. This policy defines the terms of service all customers agree to when they sign-up for hosting services with HostBelle.com. HostBelle.com reserves the exclusive right to revise, change or amend any portion of this Policy at any time.

Customers using any services offered by HostBelle.com consent to be bound by and must comply with all policies in this TOS. At the sole discretion of HostBelle.com, any violators of this TOS may have their services canceled without refund and/or, if deemed appropriate, be legally prosecuted.




General Provisions


In consideration for HostBelle.com maintaining one or more accounts (each "Account"), you agree to the following terms of service.

Definitions
  1. "We" "Us" or "Provider" or "HostBelle.com".
  2. "You" "Your" "Client" "Customer" or "Member.

Each person or entity that applies for internet service or is a designate of any one who applies for internet service.


Services provided by HostBelle.com


HostBelle.com will provide Internet server rental ("the Service") to its members for the express purpose of allowing customers to provide http Internet content to the general public. The Service allows HostBelle.com members to maintain Internet websites, receive and maintain e-mail accounts and access web space via FTP to upload files for their websites. HostBelle.com members will use the provided services in a manner consistent with any and all applicable laws of the State of Illinois and United States Federal Law. HostBelle.com provides the Services exclusively and makes no effort to edit, control, monitor or restrict the content of data other than as necessary to provide such Services.

HostBelle.com reserves the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with this policy, at its sole discretion. HostBelle.com also reserves the right to make any such modifications in an emergency at our sole discretion.

  1. Client Content: Client agrees that web pages and files uploaded to servers will not violate any province, federal or foreign laws or regulations; infringe on any intellectual property rights of HostBelle.com or any third party; be defamatory, slanderous or trade libelous; be threatening or harassing; be discriminatory based on gender, race, age; promote hate; or contain viruses or other computer programming defects which result in damage to HostBelle.com or any third party. Customers may not run IRC, bots or clients. Unacceptable uses also include: Bulk unsolicited emailing, unsolicited emailings, newsgroup spamming, child porn or links to such sites, copyrighted MP3, illegal content, copyright infringement, trademark infringement, warez, cracks and software serial numbers. HostBelle.com will be the sole and final arbiter as to what constitutes a violation of this policy. HostBelle.com does not normally monitor the contents of clients servers, however if suspicion occurs, HostBelle.com reserves the right to investigate and terminate the clients subscription to the service.
  2. Bandwidth Usage: HostBelle.com offers a generous amount of data transfer per month. Bandwidth is calculated on a recurring 30 days.
  3. Excessive Resource Usage Policy: Resources are defined as CPU and/or RAM utilization. A website is considered using "excessive amounts of resources" when it monopolizes the system resources available, using an average of 8% or more, within a 24-hour period. There are numerous issues that could cause such problems, this includes: CGI scripts, FTP, HTTP, etc. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. The client whom is using "excessive resources" will be asked to seek alternative hosting arrangements. HostBelle.com will be the sole and final arbiter as to what constitutes a violation of this policy.
  4. Upstream AUP Violation: Accounts that house insecure scripts which result in an upstream AUP violation will be charged a one-time fee of $10 for cleanup and reactivation. If your account causes a second upstream AUP violation as a result of the same script, your account will then be subject to termination at the sole discretion of HostBelle.com.
  5. No "Spam": UCE/UBE or "Spam" originating from a server located on our network or associated with a HostBelle.com server is not tolerated. This includes any e-mail that promotes web sites hosted on a server located on the HostBelle.com network but is sent from an e-mail address not associated with that HostBelle.com account. Client shall not use their HostBelle.com services for chain letters, junk mail, bulk-email, or any use of distribution lists to any person who has not given specific permission to be included in such a process. HostBelle.com reserves the right to deactivate or terminate any account(s) upon any indication of such activity without notice. There will be a $500 clean up fee if an account was suspended for a violation relating to our SPAM policy.
  6. False Information: You agree to supply HostBelle.com with a current and truthful name, postal address and telephone number for our records, and you have a continued obligation to keep this information current. You also agree that you are an authorized user of any credit card or PayPal account that you supply to us, and you understand and agree that we have an obligation to fully investigate any possible fraudulent credit card or PayPal use and prosecute if wrong doing is found.
  7. Licensed Software Only: Client agrees to use only properly licensed third party software in connection with Client's use of the Services.
  8. Sharing of account space & resale restrictions: You agree and understand that the account you purchase is purchased either for yourself or on behalf of a client if you are a reseller. You understand that as a reseller, you are the individual solely responsible for all use of the account.
  9. Abusive behavior against staff: We believe in professional communication, no matter what the issue is. We will not tolerate any abusive behavior, abusive language or threats against any HostBelle.com staff member(s). By violating this policy, we reserve the right to suspend or permanently terminate your account(s) without prior notice and without any refund.
  10. Back-Up Files: We perform routine offsite daily backups of all users' data. However, all users are encouraged to perform their own daily backups.

Payment, Renewal, Cancellations


  1. Payment Obligations: Full payment is required in advance before hosting service is established. HostBelle sends out invoices that are due every pay period. You are sent invoices seven (7) days to prior to the due-date. If you have a credit card on file, your credit card will automatically be charged each renewal period unless canceled. You warrant and represent that the information you supply in the Order Form (or other information that HostBelle.com may require) is accurate and truthful. All payment-due notices will be sent by e-mail. No bills or invoices will be sent by postal mail or fax. If payment was not received three (3) days after the due-date, your account will be suspended. To have your account re-established, you will need to pay the monthly fees. There is a $45 processing fee for illegitimate charge backs. If payment is not received thirty (30) days after the due-date, your account will be terminated.
  2. Renewals: Your account will be automatically renewed under the same time and fee structure unless you give written notice that you do not wish to renew prior to the subsequent period of service.
  3. Cancellation & Refunds: In the event you cancel your service, you will be charged in full for the entire month in which you canceled your service. Monetary refunds are awarded at any time, no questions asked, for up to ONE MONTH of service. Account cancellations for accounts with a negative balance will be passed on to collections, and all services rendered to the party with the negative balance will be terminated, including domain registrations. A $25 collections fee will be added to any accounts passed on to our third party collection agency. There is a $45 administrative fee for any illegitimate charge backs placed against us. Any illegitimate charge backs or threatened illegitimate charge backs are grounds for immediate account cancellation. Payments made for domain registrations are non-refundable. A cancellation request must be submitted through the client area OR a cancellation email, which includes your domain name, username and password, must be received by our Billing Department at billing@hostbelle.com.

100% Uptime Guarantee


HostBelle.com offers its clients a 100% server uptime guarantee for customer satisfaction purposes and also to ensure that your business is running problem free. HostBelle.com will try to maintain maximum uptime. HostBelle.com is not responsible for any downtime caused by the client.

In the rare event that HostBelle.com does not achieve our advertised 100% (monthly) for any given month, we will credit (non-monetary) your account for any downtime.

Scheduled server maintenance downtime is not covered by the guarantee. To redeem guarantee credit you must contact us in writing, send any guarantee correspondence to support@hostbelle.com. If you have an uptime monitoring report from a third party monitoring site, please include it with your e-mail. If you do not have a report, we will utilize our own third party monitoring reports to determine credit eligibility.




Refund Anytime Guarantee


HostBelle offers a Refund Anytime guarantee that covers cancellation of a hosting account, due to the inability to deliver satisfactory services. The customer will be granted a monetary refund for up to ONE MONTH of service. The guarantee does not apply to accounts with misuse or abuse. Domain registrations are non-refundable. Any questions regarding the Refund Anytime guarantee should be forwarded to billing@hostbelle.com.

 

Acceptable Use Policy


HostBelle.com's Acceptable Use Policy ("AUP") is designed to provide a clear understanding of regulations and restrictions regarding the use of HostBelle.com's services.

HostBelle.com reserves the right to modify the Acceptable Use Policy from time to time, effective on the date of posting.

By using our services, and agreeing to the Terms of Service ("TOS"), you agree to abide by the AUPs as modified from time to time. Any violation of the AUP may result in the suspension or termination of your service without notice and without refund. An activity that is unlisted may also be a violation of the AUP if it is illegal, irresponsible, or disruptive to the use of the Internet.

The violation of any AUP or any other policy is strictly prohibited and may result in the immediate suspension or termination from the services provided by HostBelle.com. You shall remain solely liable and responsible for your use of the services and any and all content that you display, upload, download or transmit through the use of HostBelle.com's servers. "Content" includes, but is not limited to; e-mail, web pages, personal home pages, and domain names. It is HostBelle.com's policy to terminate repeat offenders.




System and Network Security


Violations of system or network security is strictly prohibited, and may result in criminal and civil liability. HostBelle.com may investigate incidents involving such violations and may involve and will co-operate with law enforcement if a criminal violation is suspected. The following are some examples of network or system violations:
  1. High-risk services, which are services which tend to attract denial of service attacks, are strictly prohibited. This includes, but is not limited to, torrents and IRC related services.
  2. Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks.
  3. Forging of any TCP-IP packet header or any part of the header information in an e-mail or newsgroup posting.
  4. Unauthorized monitoring of data or traffic on any network or system without express authorization of the owner of the system or network.
  5. Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or breach security or authentication measures without express authorization of the owner of the system or network.
  6. If your account, or a subaccount (resold), is responsible for an AUP violation by an upstream provider, a one time fee of $10 will be charged to your account for cleanup and reactivation. If your account is responsible for a second AUP violation by an upstream provider for the same issue your account is subject to termination.
  7. Violators of the policy are responsible, without limitations, for the cost of labor to clean up and correct any damage done to the operation of the network and business operations supported by the network, and to respond to complaints incurred by HostBelle.com. Such labor is categorized as emergency security breach recovery and is currently charged at $150 per hour.

Password Protection


The customer is responsible for protecting the customer's password and for any authorized or unauthorized use made of customer's password. The customer will not use or permit anyone to use HostBelle.com's service to guess passwords or to access other systems or networks without authorization. HostBelle.com will fully cooperate with law enforcement authorities in the detection and prosecution of illegal activity.




Contact Information


Customers are responsible for maintaining their contact information in the ticketing system such that the email address is always reachable even in the event of their HostBelle.com account(s) or server(s) being shut down. All HostBelle customers are required to have valid full contact information on file. Accounts with false information will be suspended until valid information is placed on file.




Internet Etiquette


The customer is expected to be familiar with and to practice good Internet etiquette (Netiquette). The customer will comply with the rules appropriate to any network to which HostBelle.com may provide access. The customer should not post, transmit, or permit Internet access to information the customer desires to keep confidential. The customer is not permitted to post any material that is illegal, libelous, tortuous, or indecently depicts children, or is likely to result in retaliation against HostBelle.com by offended users. HostBelle.com reserves the right to refuse or terminate service at any time for violation of this section. This includes advertising services or sites via IRC or USENET in clear violation of the policies of the IRC channel or USENET group.




Copyright Infringement


The HostBelle.com network may only be used for lawful purposes. Transmission, distribution, or storage of any information, data or material in violation of United States or province regulation or law, or by the common law, is prohibited. This includes, but is not limited to, material protected by copyright, trademark, trade secret, or other intellectual property rights.

Making unauthorized copies of software is a violation of the law, no matter how many copies you are making. If you copy, distribute or install the software in ways that the license does not allow, you are violating federal copyright law. If caught with pirated software, you or your company may be liable under both civil and criminal law, and you may be fined up to $250,000 and/or receive up to 5 years in jail. In compliance with the Digital Millennium Copyright Act (the "DMCA"), please send DMCA notifications of claimed copyright infringements to abuse@hostbelle.com. HostBelle.com will cooperate fully with any civil and/or criminal litigation arising from the violation of this policy.




Network Responsibility


Customers have a responsibility to use the HostBelle.com network responsibly. This includes respecting the other customers of HostBelle.com. HostBelle.com reserves the right to suspend and or cancel service with any Customer who uses the HostBelle.com network in such a way that adversely affects other HostBelle.com customers. This includes but is not limited to:
  1. Attacking or attempting to gain unauthorized access to servers and services that belong to HostBelle.com or its customers (i.e. computer hacking), and/or
  2. Participating in behavior which results in reprisals that adversely affect the HostBelle.com network or other customers' access to the HostBelle.com network.
HostBelle.com will react strongly to any use or attempted use of an Internet account or computer without the owner's authorization. Such attempts include, but are not limited to, "Internet Scanning" (tricking other people into releasing their passwords), password robbery, security hole scanning, port scanning, etc. Any unauthorized use of accounts or computers by a HostBelle.com customer, whether or not the attacked account or computer belongs to HostBelle.com, will result in severe action taken against the attacker. Possible actions include warnings, account suspension or cancellation, and civil or criminal legal action, depending on the seriousness of the attack. Any attempt to undermine or cause harm to a server, or customer, of HostBelle.com is strictly prohibited.

Violations of this policy may be reported directly to the FBI (http://www.fbi.gov). HostBelle.com will cooperate fully with any civil and/or criminal litigation arising from the violation of this policy.


Lawful Purpose


All services may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any applicable law, regulation, or AUP is prohibited. This includes, but is not limited to:
  1. Copyrighted material or material protected by trade secret and other statute or dissemination of harmful or fraudulent content.
  2. Using any HostBelle.com service or product for the purpose of participating in any activity dealing with subject matters that are prohibited under applicable law is prohibited.
Any conduct that constitutes harassment, fraud, stalking, abuse, or a violation of federal export restriction in connection with use of HostBelle.com services or products is prohibited. Using the HostBelle.com network to solicit the performance of any illegal activity is also prohibited, even if the activity itself is not performed. In addition, knowingly receiving or downloading a file that cannot be legally distributed, even without the act of distribution, is prohibited.

Servers hosted within HostBelle.com's network are open to the public. You are solely responsible for your usage of the HostBelle.com network and servers and any statement you make on servers hosted within the HostBelle.com network may be deemed "publication" of the information entered. Acknowledging the foregoing, you specifically agree not to use our service in any manner that is illegal or libelous.


Child Pornography on the Internet


Our policy on child pornography is zero tolerance. HostBelle.com will cooperate fully with any criminal investigation into a Customer's violation of the Child Protection Act of 1984 concerning child pornography. Customers are ultimately responsible for the actions of their clients over the HostBelle.com network, and will be liable for illegal material posted by their clients.

According to the Child Protection Act, child pornography includes photographs, films, video or any other type of visual presentation that shows a person who is or is depicted as being under the age of eighteen years and is engaged in or is depicted as engaged in explicit sexual activity, or the dominant characteristic of which is the depiction, for a sexual purpose, of a sexual organ or the anal region of a person under the age of eighteen years or any written material or visual representation that advocates or counsels sexual activity with a person under the age of eighteen years.




Commercial Advertisements with E-mail


HostBelle.com takes a zero tolerance approach to the sending of Unsolicited Commercial E-mail (UCE) or SPAM over our network. Very simply, this means that customers of HostBelle.com may not use or permit others to use our network to transact in UCE. Customers of HostBelle.com may not host, or permit hosting of, sites or information that is advertised by UCE from other networks. Violations of this policy carry severe penalties, including termination of service.

Sending a message, especially an advertisement, to more than five recipients, is by itself spamming unless the individuals have specifically requested to be added to a mailing list on that topic. This includes commercial advertisements and informational messages sent to recipients via electronic mail (email) as well as off-topic messages posted in Usenet discussion groups where the recipient has not requested or invited the message. Mailing lists must be true opt-in mailing lists. Before sending any email to a listed user, a confirmation email, with a tracking number, must be sent to the new subscriber, to which they must respond with a confirmation that they wish to be added to the list. You must keep these confirmations on file, so that in the case that a spam complaint is made against you, you have proof that the user did indeed opt-in. In addition, you must provide at least one easy way to opt out; see the MAPS guidelines (http://mail-abuse.org/rbl/manage.html) for details. Opt-out requests must be honored immediately.

E-mail is a person-to-person medium, not a broadcast medium.

Customers of HostBelle.com are strictly prohibited from using or permitting others to use UCE or SPAM over our network. As our Customers are ultimately responsible for the actions of their clients over the HostBelle.com network, it is advisable that Customers develop a similar, or stricter, policy for their clients.

Violation of HostBelle.com's SPAM policy will result in severe penalties. Upon notification of an alleged violation of our SPAM policy, HostBelle.com will initiate an immediate investigation (within 48 hours of notification). During the investigation, HostBelle.com may restrict customer access to the network to prevent further violations. If a customer is found to be in violation of our SPAM policy, HostBelle.com may, at its sole discretion, restrict, suspend or terminate customer's account. Further, HostBelle.com reserves the right to pursue civil remedies for any costs associated with the investigation of a substantiated policy violation. HostBelle.com will notify law enforcement officials if the violation is believed to be a criminal offense.

Violation of HostBelle.com's SPAM policy may be reported to abuse@hostbelle.com.




IRC


HostBelle.com does not allow the use of IRC on the HostBelle.com network. This includes, but is not limited to, the use of IRC clients, server software, bots or anything related to IRC. Violators' servers or shared accounts will be suspended.




Billing


The customer understands that the customer is responsible for paying for any network resources that are used to connect the customer's server or hosting plan to the Internet. The customer may request that the customer's server be disconnected from the Internet, but the customer will still be responsible for paying for any network resources used up to the point of suspension or cancellation.




Suspension


HostBelle.com reserves the right to suspend network access to any customer if, in the judgment of the HostBelle.com network administrators, the customer's server is the source or target of the violation of any of the other terms of the AUPs or for any other reason which HostBelle.com chooses. If inappropriate activity is detected, all accounts of the Customer in question will be deactivated until an investigation is complete. In extreme cases, law enforcement will be contacted regarding the activity. The customer will not be credited for the time the customer's machines were suspended.




Cancellation


If inappropriate activity is detected, all accounts of the customer in question will be deactivated until an investigation is complete. In extreme cases, law enforcement will be contacted regarding the activity. All fees paid in advance of cancellation are non-refundable if HostBelle.com institutes its right of cancellation. Any violation of policies, which results in extra costs, will be billed to the customer (i.e. transfer, space etc.).




Indemnification


HostBelle.com wishes to emphasize that in signing the Master Services Agreement or its equivalent, customer indemnifies HostBelle.com for any violation of the Master Services Agreement or its equivalent, law or AUP that results in loss to HostBelle.com or the bringing of any claim against HostBelle.com by any third-party. This means that if HostBelle.com is sued because of a customer's or a customer of a customer's activity, the customer will pay any damages awarded against HostBelle.com, plus costs and reasonable attorney's fees.




Disclaimer of Responsibility


HostBelle.com is under no duty to look at each customer's or user's activities to determine if a violation of the AUPs has occurred, nor do we assume any responsibility through our AUPs to monitor or police Internet-related activities. HostBelle.com disclaims any responsibility for any such inappropriate use and any liability to any person or party for any other person's or party's violation of this policy.

All customers of HostBelle.com must adhere to the above policies. Failure to follow any term or condition will be grounds for immediate Cancellation.

Indirect or attempted violations of the AUPs and actual or attempted violations by a third party on your behalf shall be considered violations of these AUPs by you.

 

Privacy Policy


HostBelle.com respects the privacy and security of its customers and users of its website. HostBelle strives to provide you with a personalized Internet experience that delivers to you the information, products and services that you need. In order to achieve this goal, HostBelle sometimes collects information during your visits to our website.

HostBelle promises that:
  1. We do not and will not offer for sale, share, or lease any information given to us by you, except as disclosed in this privacy policy (“Privacy Policy”).
  2. Our Privacy Policy applies to prospective, current, and former customers and users.
We have prepared this Privacy Policy to enable you to understand which personal identifying information of yours is collected, how and when we might use your information, how we protect your information, who has access to your information, and how you can correct any inaccuracies in the information. This Privacy Policy is not intended to and does not create any contractual or other legal rights in or on behalf of any party.


Information We Collect


HostBelle collects certain information from and about its users in three ways: (I) from our web server logs, (II) with cookies and (III) directly from the user.

Web server logs: When you visit our website, HostBelle may collect “Non-Personally Identifiable” information to administer the site and analyze its usage, such as:
  1. Your Internet protocol address (explained below);
  2. The type of browser or computer you use;
  3. The number of links you click within our website;
  4. The state or country from which you accessed our website;
  5. The date and time of your visit;
  6. The name of your Internet service provider;
  7. The web page from which you linked to our website; and
  8. The pages you viewed on our website.

Internet Protocol (“IP”) Address


An IP Address is a number assigned to your computer while using the Internet from which Web servers can automatically identify your computer. HostBelle servers gather your IP address and the webpage from where you linked to our website. Your IP address assists HostBelle in administering and optimizing the website for you, analyzing website usage, and diagnosing problems with the website.




Cookies


Our website uses cookies (i.e., small bits of text that our servers place into a file on your computer's hard drive). We use cookies to save your preferences and login information, and provide personalized functionality. Cookies may also store Personally Identifiable Information (defined below) you have entered so that you do not have to continually reenter the same information. You can reject cookies by changing your browser settings, but be aware that this will disable some of the functionality on the HostBelle website.




Personally Identifiable Information


On some pages of our website, users can register to purchase products or services, receive personalized content and participate in polls or contests. When you register, HostBelle may ask you for some personal information, which may include, but not limited to, your full name, postal address, phone number and email address. We may then contact you with information about HostBelle products and services.

If you purchase products or services, we may also request financial information such as credit card or bank account information. Any financial information we collect is used only to bill you for the products and services you purchased. If you purchase by credit card, this information may be forwarded to your credit card provider.




Additional Information


As a security measure and to ensure that our website and computer network remain available to all customers, HostBelle may use software programs to monitor network traffic or to identify unauthorized attempts to upload or change information, or otherwise cause damage. These software programs may also collect information regarding your use of our website and computer network.

You may also be asked to disclose personal information to us so that we can provide technical support assistance and information to you. For example, we may collect personal information from you (such as an e-mail address, system information and problem descriptions) in order to provide online technical support and troubleshooting. If you choose to correspond with us through electronic communication (e.g. email, online chat or instant messaging), we may retain a copy of the electronic communication together with your email address and our responses. We provide the same protections for these electronic communications that we employ in the maintenance of information received by mail and telephone.




How We Use Your Information


HostBelle uses the information we collect to notify you about your account and to notify you about changes to the terms and conditions governing your use of our website, products and services. We may also use the information we collect to notify you about other products and services we think you will find valuable and about special offers. You may notify us of your desire not to receive notifications relating to new products and services and special offers by “opting-out” as provided for below. Our employees, contractors, or agents will at times require access to your Personally Identifiable information. HostBelle permits access to such information only for business purposes, such as administration and developing our products or services.




Information Released


HostBelle may release some customer Non-Personally Identifiable information, this website’s traffic patterns, and related website usage information to our affiliates and reputable third parties on an aggregated basis. We take measures to select product or service providers that are responsible and afford similar privacy protections to their customers. However, we do not make any representations about the practices and policies of these companies.

HostBelle may share or disclose Personally Identifiable information with agents and contractors who use such information on behalf of HostBelle or in connection with administering or delivering products and services on behalf of HostBelle.

Special Cases of Release
Both Personally Identifiable and Non-Personally Identifiable information may be transferred to a third party:
  1. As required by law, in a matter of public safety or policy, or as compelled by a court of law
  2. In the event of a change of ownership or assets; and
  3. To affiliated entities of common control, such as subsidiaries and parent companies. The use of your information by these affiliates of common control will comply with this Privacy Policy.

Contacting You Directly


HostBelle may contact you directly through the email address or other information you provide to confirm information or purchases we have successfully received from you. HostBelle will also contact you to respond to your questions, to provide the services you request, to manage your account, and/or to inform you of any service announcements.




Opt-Out Provision


If you don't want to receive promotional materials from HostBelle, you may opt out at any time. You may "opt out" by contacting us at contact@hostbelle.com. Upon properly opting-out, HostBelle will take reasonable efforts to delete a user's personal information from its database. However, please note that it may be impossible to entirely delete a user's information because some residual information may reside on backups or records of deletions.




Children


In accordance with the Children’s Online Privacy Protection Act (COPPA), HostBelle does not knowingly collect or solicit any Personally Identifiable information from children under the age of thirteen (13).




How We Protect Your Information
